OVERVIEW
The Planning Act sets out the process for handling an application to approve a Conditional Use for aggregate quarry developments. The Council having jurisdiction may consider it appropriate to impose conditions on the proposed use in order to ensure that it will be acceptable at the proposed location.
PROCESS
Conditional Uses for aggregate quarries require an additional step. Section 169(5) of The Planning Act requires a copy of the notice of a conditional use to be sent to the Minister at least 60 days before the matter is heard by Council. The 60-day notice period on aggregate proposals provides the opportunity for a Provincial interdepartmental technical review to help inform the local decision-making process. The Provincial planning report will be made available prior to the conditional use public hearing.
After holding the hearing, Council must make an "order” respecting its decision. Council has the authority to reject the requested Conditional Use, or approve the Conditional Use provided the Conditional Use:
a) will be compatible with the general nature of the surrounding area;
b) will not be detrimental to the health or general welfare of people living or working in the surrounding area, or negatively affect other properties or potential development in the surrounding area; and
c) is generally consistent with the applicable provisions of the development plan by-law, the zoning by-law and any secondary plan by-law.
When approving an application for a Conditional Use, Council may impose any conditions on the approval that it considers necessary to meet the requirements listed above.
NOTE: For aggregate quarry Conditional Use applications in the R.M. of Rosser, a Quarry Permit is required in accordance with the R.M. of Rosser Quarry Operations By-law No. 8-15. Please inquire directly with the R.M. of Rosser on these municipal by-law requirements.
The aggregate quarries Conditional Use process takes approximately 3-5 months from the date of submission of a complete application to a decision. To confirm the timeline for your application, please contact the SIPD.

APPLICATION REQUIREMENTS
To initiate an aggregate quarry Conditional Use application, the following application requirements must be submitted to the SIPD:
- Completed Application Form (Click Here for PDF);
- Detailed Letter of Intent, including but not limited to:
- Overview of the proposed development;
- Site plan / layout;
- Proposed buffers (e.g., berms, vegetative, fencing, etc.);
- Phasing plan (e.g., excavation, progressive rehabilitation, etc.);
- Hours of operation;
- Current land use(s) on the site;
- Surrounding land uses;
- Existing geological conditions;
- Existing groundwater conditions;
- Details on proposed progressive rehabilitation;
- Water management;
- Proposed haul routes and projected traffic volumes/impacts;
- Proposed nuisance mitigation measures (e.g., noise, dust, traffic, etc.);
- Background on proponent (e.g., company history, status of existing quarries, etc.);
- Development Plan conformity;
- Zoning By-law conformity;
- Applicable Provincial regulations.

These are minimum application requirements. Additional information or studies may be required depending on the nature of the application. Incomplete applications will not be accepted.
